Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and Melcom Group Ltd., a company incorporated in Alberta, Canada("Wordhaven", "we", "us", "our"), and govern your access to and use of wordhaven.io and the related software, APIs, and services (collectively, the "Service"). By creating an account, clicking "I agree", or otherwise using the Service, you accept these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
1. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. You must provide accurate registration information and keep it current. You are responsible for all activity on your account, including any activity by people you authorize to use your account.
2. Your account
You may create an account using email and password or by signing in with a supported identity provider (currently Google). You are responsible for keeping your password and any access tokens confidential. Notify us at support@wordhaven.io immediately if you suspect unauthorized access to your account.
You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms, if your use creates a security or legal risk, or if continued service is no longer commercially reasonable. See Section 13 (Termination).
3. What the Service does
Wordhaven provides software-assisted analysis and editing tools for written manuscripts. The Service includes simulated "reader" persona tests that produce predicted ratings, finish-rate estimates, and chapter-level engagement signals; copy, line, developmental, business, and final-proofread editing passes that return suggested findings; and book-level organization tools (library, score history, exports).
The Service’s outputs are estimates and suggestions, not facts.Reader Test predictions are statistical models based on simulated personas — they are not market research, sales projections, or a guarantee of how any real reader, retailer, or platform will respond. Editing findings are suggestions, not instructions; you are the author and you decide what to accept or reject.
AI outputs are provided for informational and suggestive purposes only. They are not professional editing, publishing, legal, or financial advice, and they may be incomplete, inaccurate, or generic. Wordhaven does not guarantee publication, reader reviews, retailer placement, sales, or commercial success of any kind. You are responsible for reviewing outputs before relying on them or publishing anything based on them. Use of AI outputs is at your own discretion and risk.
4. Your content
You retain all rights to the manuscripts, text, covers, blurbs, and other materials you upload or submit to the Service ("Your Content"). Wordhaven does not claim ownership of Your Content.
You grant Wordhaven a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and create derivative analyses of Your Content solely for the purpose of operating, providing, securing, and improving the Service for you. This license ends when you delete Your Content from your account or when your account is terminated, except as required by law, for ordinary backups, or for the limited record-keeping permitted by our Privacy Policy.
You represent and warrant that you own Your Content or have all rights necessary to upload it and grant the license above, and that Your Content does not infringe any third party’s intellectual property, privacy, publicity, or other rights.
4.1 Use of third-party AI providers
To produce the Service’s analyses, portions of Your Content are sent to third-party large language model ("LLM") providers, including OpenRouter and Anthropic. We send only the portions necessary to perform the requested operation. Our current providers contractually commit not to train their models on customer content sent through their APIs. We will not knowingly engage a provider that does not offer at least an equivalent commitment. A current list of sub-processors is available on request.
4.2 No AI training on your manuscripts without your opt-in
We do not use user manuscripts to train or fine-tune AI models — ours, our providers’, or anyone else’s — without your explicit opt-in. If we later ask for your consent to include Your Content in a training set, the request will be clearly labeled as such, purely optional, and limited to the specific purpose we describe at the time. Declining will not affect your access to the Service. Any such consent may be revoked prospectively at any time by contacting support@wordhaven.io.
4.3 Prohibited content
You may not upload or submit content that:
- infringes copyright, trademark, trade-secret, privacy, or publicity rights;
- contains child sexual abuse material or content that sexualizes minors;
- contains real, individually identifiable third parties presented in a defamatory or sexually explicit way without consent;
- is intended to harass, threaten, or incite violence against a specific person or group; or
- violates applicable law in any jurisdiction where you or we operate.
We may remove content that violates these rules and may suspend or terminate accounts that repeatedly do so.
5. Plans, payments, and refunds
5.1 What we sell
The Service is sold in the following product shapes:
- One-time runs — Quick Reader Test ($19) and Full Manuscript Review ($99). One charge, one run, no recurring billing.
- Subscriptions offered to new customers — Author ($49.99/month, $210/six months, or $360/year) and Pro ($79.99/month). These are recurring charges until canceled. The plan tier determines which features are available while the subscription is active.
- Four-pass editing packages — developmental, line, copy, and final-proof passes priced by manuscript length: 30,000 words or fewer ($249), 60,000 words or fewer ($399), 90,000 words or fewer ($599), 120,000 words or fewer ($799). An active Author or Pro membership is required. Manuscripts over 120,000 words require a custom quote.
- Legacy purchases — Wordhaven no longer sells lifetime or Studio plans. Existing Author ($199), Pro ($399), and Studio ($749) lifetime purchases and Studio ($79/month) subscriptions remain governed by the terms accepted when purchased. Legacy Studio includes three team seats; additional seats are $15/month.
- Signup grants — a new account currently receives 0 Quick Reader Tests and no first-chapter analysis on signup.
Posted prices include applicable processing fees but exclude taxes, which we add at checkout where required. We may change the price of new plans at any time; price changes do not affect existing subscriptions until the next renewal and do not revoke a legacy lifetime purchase.
5.2 Payment processing
Payments are processed by Stripe. By purchasing a one-time run, subscription, editing package, or legacy lifetime plan, you authorize Wordhaven and Stripe to charge your designated payment method and, for subscriptions, to charge it again on each renewal date until you cancel. You represent that you are authorized to use the payment method you provide. We do not store full payment card data on our servers.
5.3 Refund policy
We want you to feel good about every purchase. The following refund windows apply:
- Pay-per-use runs (Quick Reader Test, Full Manuscript Review): full refund within 14 days of purchase if you have run 3 or fewer analyses against that purchase.
- Monthly subscriptions: non-refundable. Cancellation stops future renewals; the plan remains active through the end of the current billing cycle and is not prorated.
- Lifetime purchases: full refund within 30 days of purchase. We assume you took us up on the lifetime price because you were confident — that refund window is there to make that confidence safe.
- Failed runs: if a run fails to produce a result for technical reasons attributable to us, we will automatically credit your account or refund it on request, regardless of any other window.
After the windows above, refunds are only issued where required by applicable consumer-protection law. Requests go to support@wordhaven.io. Refunds are issued to the original payment method, typically within 5–10 business days depending on your card issuer. Chargebacks initiated without first contacting us may result in account suspension while the dispute is resolved.
6. Acceptable use
You agree not to:
- reverse engineer, decompile, or attempt to extract the source code of the Service, except as expressly permitted by law;
- resell, sublicense, or otherwise commercialize the Service as a standalone offering;
- use the Service to build a competing product or to train a competing model;
- circumvent rate limits, credit accounting, or other technical or commercial controls;
- upload viruses, malware, or any code intended to damage the Service or other users;
- use the Service to violate applicable export-control, sanctions, or anti-money-laundering laws;
- use the Service to generate automated content that is published without meaningful human review when doing so would violate the policies of a platform where that content will appear.
7. Privacy
Our handling of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Wordhaven’s intellectual property
The Service, the wordhaven.io website, the underlying software, the Wordhaven name, the arched-W mark, the visual design, and all related materials are owned by Melcom Group Ltd. or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms for your personal or internal business purposes. All rights not expressly granted are reserved.
9. Feedback
If you send us suggestions, ideas, or feature requests, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose without compensation or attribution. You can always also tell us nothing.
10. Copyright complaints
If you believe content on the Service infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to support@wordhaven.io with the subject line "DMCA Notice". Repeat infringers will have their accounts terminated.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WORDHAVEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Service will be uninterrupted, error-free, secure against every threat, or that the analyses produced will be accurate, complete, or commercially useful. You are responsible for your own creative and business decisions.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST GOODWILL, OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY.
- WORDHAVEN’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID WORDHAVEN IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
You acknowledge that this cap is a fundamental basis of the bargain between you and Wordhaven; without it, we would not be able to offer the Service at the prices we do.
Some jurisdictions do not allow exclusion of certain warranties or limitations on certain damages; in those jurisdictions, the above limitations apply to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Melcom Group Ltd. and its officers, directors, employees, and agents from any third-party claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of (a) Your Content, (b) your breach of these Terms, or (c) your violation of any law or third-party right.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay amounts you owe, or use the Service in a way that creates legal or security risk for us or other users. On termination, the licenses you grant under Section 4 will end on the schedule described there; Sections that by their nature should survive (including Sections 4 (your representations), 8–13, and this Section 14) will survive.
15. Changes to the Service or these Terms
We may modify the Service and these Terms from time to time. If we make a material change to these Terms, we will give you reasonable advance notice (typically by email or by posting a prominent notice in the Service) before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, your remedy is to stop using the Service before the change takes effect.
16. Governing law and venue
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The parties consent to the exclusive personal jurisdiction of, and venue in, the the courts of the Province of Alberta, Canada for any dispute not subject to arbitration under Section 17.
17. Disputes — informal resolution first; arbitration; class waiver
Talk to us first. Before filing any claim, you agree to contact us at support@wordhaven.io and give us 30 days to attempt informal resolution.
Any dispute that cannot be resolved informally and that is not subject to small claims court jurisdiction will be resolved by binding individual arbitration administered by the ADR Institute of Canada under its Arbitration Rules, by a single arbitrator, in the English language, with the seat of arbitration in Calgary, Alberta. The arbitrator may award the same individual relief a court could. You and Wordhaven agree to bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. If this class waiver is found unenforceable, the rest of this Section 17 is severable.
You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms by emailing support@wordhaven.io with the subject line "Arbitration Opt-Out" and your account email. Opting out does not affect any other part of these Terms.
18. Miscellaneous
These Terms, together with the Privacy Policy and any order or pricing terms you accept at checkout, are the entire agreement between you and Wordhaven about the Service. If any provision is held unenforceable, the remaining provisions remain in full force. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign these Terms without our written consent. No waiver of any term is a waiver of any other or subsequent term. Notices to you may be sent to the email associated with your account; notices to us must be sent to support@wordhaven.io.
